Making a planning application for a tree with a Tree Preservation Order (TPO)

Across the UK, many trees which are recognised as environmentally or historically significant, are protected with a Tree Preservation Order, referred to as TPO. A TPO is a legal registration made by your local planning authority and can be applied to single or a group of trees and woodland areas; they do not apply to bushes, hedgerows or shrubs.

If a tree has been registered with a TPO, it means that you cannot prune, cut down, or damage the tree without special permission from the local council. Failure to do so, could result in a hefty fine of up to £20,000.00 or even receive a series of fines in some cases.

Most councils provide online information with regards to TPOs, in terms of which trees are registered within the area. Before pruning a tree, you must check as to whether it is protected by a TPO. TPO trees are also often referred to through property conveyancing, when a property or land is purchased.

How arboriculturists support clients with TPO trees on their land

If you do have trees which are TPO protected it is your responsibility to look after them. If you feel that they need pruning and tidying due to hazardous or dead branches, then you will need to apply for a planning application via your local arboriculturist. Arboriculturists are qualified to review trees and make applications to local authorities, on behalf of landowners.

To make an application, the arboriculturist will consult with the landowner on their requirements, assess the tree’s health, and provide safety suggestions. They will then submit a report to the local authority for pruning recommendations and within accordance with local authority regulation.

If your application is approved by the local authority, the landowner can proceed with a local tree surgeon to have the tree pruned and the green waste removed from the property site, in accordance with the local authority’s approved specification.

If the application isn’t accepted, then the arboriculturist will work closely with the client (the landowner) and the local authority to come to an agreement as to how the tree can be maintained in going forward.
